FLORIDA STATUTE MANDATES THAT REAL ESTATE LICENSEES FURNISH THIS NOTICE TO PROSPECTIVE SELLERS AND PURCHASERS OF REAL PROPERTY.

It should not be presumed that any real estate broker or salesperson is acting as your representative unless a formal agreement has been established to engage a real estate licensee in an authorized brokerage relationship, specifically as a single agent or a transactional broker. You are advised to refrain from disclosing any confidential information until a decision regarding representation has been finalized.

NOTICE OF ABSENCE OF BROKERAGE RELATIONSHIP

FLORIDA LAW REQUIRES REAL ESTATE LICENSEES WHO DO NOT MAINTAIN A BROKERAGE RELATIONSHIP WITH A PROSPECTIVE SELLER OR PURCHASER TO DISCLOSE THEIR OBLIGATIONS TO SAID SELLERS AND PURCHASERS.

  • To conduct all dealings with honesty and impartiality;
  • To disclose all known facts that materially impact the value of residential real property, provided these facts are not readily discernible by the purchaser;
  • To provide a full accounting for all funds entrusted to the licensee.

Property Condition Disclosures

As-Is Sales

Unless otherwise stated, properties on our platform are sold "as-is, where-is" with all faults. This means:

  • The seller makes no warranties or representations about the property condition
  • Buyers should conduct their own inspections and due diligence
  • Buyers accept the property in its current state at the time of sale
  • No repairs or improvements are guaranteed by the seller

Known Material Defects

Sellers are required to disclose known material defects that affect the property's value or desirability. However:

  • Sellers may not be aware of all defects
  • Hidden or latent defects may exist
  • Prior repairs may not have been completed to code
  • Systems and appliances may fail after purchase

Buyer Responsibility

Buyers are strongly encouraged to conduct professional inspections of the property before bidding, including but not limited to: general home inspection, pest inspection, roof inspection, HVAC inspection, plumbing, electrical, structural engineering, and environmental assessments. The cost of inspections is the buyer's responsibility.

Lead-Based Paint Disclosure

For properties built before 1978, federal law requires disclosure of known lead-based paint and lead-based paint hazards:

  • Sellers must disclose known information about lead-based paint and hazards
  • Buyers have 10 days to conduct a lead-based paint inspection (unless waived)
  • Buyers receive the EPA pamphlet "Protect Your Family from Lead in Your Home"
  • Warning statements must be included in sales contracts

Lead-based paint may be present in pre-1978 properties even if not disclosed, as sellers may not have knowledge of all lead paint in the home.

Natural Hazard Disclosures

Properties may be located in areas subject to natural hazards. Depending on location, required disclosures may include:

  • Flood hazard zones (FEMA maps)
  • Earthquake fault zones
  • Fire hazard severity zones
  • Seismic hazard zones
  • Coastal zones and tsunami risk
  • Hurricane zones
  • Tornado-prone areas

Buyers should research local hazards, obtain appropriate insurance, and consider the impact on property values and insurability.

Title and Ownership

Title Insurance

Buyers are strongly encouraged to obtain title insurance to protect against:

  • Undisclosed liens or encumbrances
  • Errors in public records
  • Unknown heirs claiming ownership
  • Forgery and fraud in the chain of title
  • Survey errors or boundary disputes

Liens and Encumbrances

Properties may be sold subject to certain liens, easements, or restrictions. Buyers should review the preliminary title report carefully and consult with legal counsel regarding any concerns about title issues.

Financial Considerations

Buyer's Premium

A buyer's premium is added to the final bid price. This premium is disclosed in the property listing and becomes part of the total purchase price. The buyer's premium compensates the auctioneer and platform for services rendered.

Property Taxes

Property taxes shown in listings are estimates based on prior year assessments. Actual taxes may differ due to:

  • Assessment changes after sale
  • Tax rate changes
  • Loss of exemptions or special assessments
  • New improvements or construction

Homeowners Association (HOA)

If applicable, properties may be subject to HOA fees, rules, and restrictions. Buyers should review HOA documents, financial statements, and rules before bidding. HOA fees may increase over time.

Auction-Specific Disclosures

Binding Contracts

When you place a bid in our auctions, you are entering into a legally binding contract. Winning bidders are obligated to complete the purchase according to the terms stated in the auction listing and purchase agreement.

Reserve Prices

Some auctions have reserve prices (minimum acceptable prices) that are not disclosed. If bidding does not reach the reserve, the seller is not obligated to sell. Auctions without reserves sell to the highest bidder regardless of price.

Platform Reliability

While we strive to maintain platform uptime, technical issues may occur. We are not liable for bid failures, connection issues, or other technical problems that prevent bidding. Bidders are responsible for ensuring they can participate in auctions.
